I think the court is at a nadir. Of course that is not a case that I can make in a bookstore talk. I am writing a book about the federal judiciary which contains a chapter of more than one hundred pages setting forth my views of the current court and my grounds for those views.

Posner, who has a book on the federal judiciary out this month, also lamented that the current court is dominated by "extremely reactionary judges appointed by Bush, mainly" but acknowledged that his ideas to improve the court were "quixotic.
It isn't his first complaint about the Supreme Court. In October he said the court had "reached a nadir" and was "awful. And earlier this month he said in a conversation published by Slate that there should be " mandatory retirement for all judges at a fixed age , probably 80," adding that appointment to the Supreme Court should not be limited to lawyers because brilliant businessmen, politicians or teachers could rely on "brilliant law clerks for the legal technicalities" and "most of the technicalities are antiquated crap," anyway.
